TÉRMINOS Y CONDICIONES – CONSULTAS TELESALUD

  

El propósito de este documento es establecer los términos y condiciones aplicables a las consultas de Telesalud ofrecidas por Centro Ararat, Inc. y/o una de sus corporaciones relacionadas. Estas entidades, incluyendo sus empleados y otras dependencias que actúan en su nombre, se referirán de manera colectiva en este documento como "Clínica Ararat", "nuestro"o "nosotros".


  

SU INFORMACIÓN PERSONAL Y DE SALUD


  1. Nuestra Política de  Privacidad está disponible en los sitios web https://centroararat.org y https://ProtegeLoQueAmas.com (de ahora en adelante identificados como “nuestro  sitio web”). Dicha política resume las disposiciones de la La Ley de Transferencia y Responsabilidad de Seguro Médico (Health Insurance Portability and Accountability Act, HIPAA por sus siglas en inglés) de 1996. 
  2. La Política establece que, mediante el uso de nuestro sitio web y/o cualquier portal digital, que se accede a través de nuestro sitio web (denominados a continuación como “portales digitales”). Usted podrá recibir productos u otros servicios disponibles en Clínica Ararat. Esto incluye realizar consultas con un médico u otro profesional clínico a través del servicio de Telesalud.


PROCESO DE REALIZACIÓN DE CONSULTAS Y LA PROTECCIÓN DE SU INFORMACIÓN


  1. Para acceder al servicio de Telesalud en la Clínica Ararat, usted se registrará utilizando un portal digital en nuestro sitio web. 
  2. Para crear una cuenta, usted proporcionará la información solicita en el portal digital.
  3. El proceso de hacer una cita para la consulta ser hará a través de uno o más portales digitales manejados por terceros, plataformas u otros programas de software que no son propiedad de Centro Ararat, Inc.
  4. La información de su cuenta (incluidas las credenciales de inicio de sesión y contraseñas) es confidencial  y será su responsabilidad mantener la seguridad y privacidad de sus datos.
  5. No deberá permitir que  su cuenta sea utilizada por ninguna persona que no sea usted.
  6. Usted se responsabilizará por cualquier actividad no autorizada como resultado de haber compartido la información de su cuenta a terceras personas.
  7. En caso de que tuviera conocimiento, sospecha o cualquier otra violación sobre el uso no autorizado de su cuenta, usted notificará la situación inmediatamente a Clínica Ararat. En ese caso, A su discreción, Clínica Ararat determinará suspender, cancelar o crear una nueva cuenta para usted.


TÉRMINOS


Con su acceso a este sistema, usted acepta los siguientes términos:


  1. Proporcionar información precisa, actual y completa a Clínica Ararat en relación con su cita, completar cualquier cuestionario que se le proporcione, y responder a otras preguntas o solicitudes de información requerida por Centro Ararat en relación con o durante el proceso de consulta.
  2. Entender que la capacidad de Clínica Ararat para proveerle información, tratamiento y recomendaciones médicas precisas dependerá de que la información de salud que usted provista sea precisa, actual y completa en todo momento. 
  3. Reconocer que Clínica Ararat no tiene la obligación de darle ninguna explicación o razones sobre cualquier decisión sobre no aceptar, cancelar o negarse a mantener su cuenta o a proporcionarle una consulta a través de Telesalud.


CONDICIONES


  1. No aceptar o cancelar cualquier cita realizada para una consulta de Telesalud y/o, a su discreción, negarse a registrar, mantener o cancelar su cuenta, por cualquier motivo.
  2. Cancelar, terminar, negarse a registrar o mantener su cuenta o proporcionarle una consulta a su absoluta discreción si usted ha suministrado información falsa o engañosa durante una consulta a través de Telesalud.
  3. Proveer una consulta de Telesalud a través del médico o profesional de la salud que esté disponible al momento de su cita.
  4. Limitar el tiempo de consulta a un tiempo máximo de quince (15) minutos.
  5. Facturar el tiempo de la consulta a su seguro de salud.
  6. Promover una consulta de carácter general que se ofrecerá solamente a través del teléfono, videoconferencia o por Internet.
  7. No involucrarse u obligarse a aprobar, solicitar o hacer cualquier prueba de patología, análisis clínicos u otros estudios médicos.
  8. Referir su caso a otro profesional de la salud si el médico disponible en Telesalud, al momento de su consulta, lo estime pertinente.
  9. En la medida máxima permitida por ley, liberarse de toda responsabilidad como Clínica Ararat (incluyendo a sus directores, funcionarios, empleados, contratistas y agentes debidamente autorizados) contra toda pérdida, daño, costo y gasto (directos, indirectos, especiales o consecuentes) que usted sufra o incurra como resultado de, en relación con, en conexión con o surgidos por una consulta de Telesalud.
  10. Responsabilizar al cliente por el uso indebido de nuestro sitio web y portales digitales para propósitos no autorizados, incluyendo hackear, infiltrarse, comprometer, interferir, interceptar o acceder a cualquier cuenta o información personal o de salud de cualquier otra persona en o a través del sitio web, software o aplicaciones asociadas.
  11. Emprender o tomar acciones si se introdujera algún virus informático, virus macro, troyano, gusano o cualquier otro elemento cibernético diseñado para interferir, interrumpir o clausurar los procedimientos y funcionamientos normales de un sistema o red de computadoras, nuestro sitio web, cualquier software o aplicaciones asociadas.
  12. Enfatizar en que usted no podrá autorizar, ayudar, instigar o asistir a cualquier otro individuo o entidad a participar en ninguna actividad o hacer cualesquiera acciones mencionadas en los incisos 10 y 11.
  13. Modificar, actualizar o variar estos términos y condiciones, siempre y cuando que, en el caso de realizar dichos cambios, sean publicados los términos y condiciones ya actualizados, variados o modificados en nuestro sitio web, que le obligan a aceptarlos efectivo en y a partir de la fecha de publicación.
  14. Recalcar en su responsabilidad de revisar periódicamente nuestro sitio web para determinar o corroborar si ha habido algún cambio en estos términos y condiciones, según indicado en el inciso 13.


CONSIDERACIONES ADICIONALES


  1. Los Términos y Condiciones incluidos en este documento están sujetos a las leyes del Estado Libre Asociado de Puerto Rico. En caso de cualquier reclamo legal contra Centro Ararat, Inc., Clínica Ararat, sus directivos, empleados o representantes, se hará en los tribunales estatales. De igual manera, usted renunciará a su derecho de incoar una demanda en el Tribunal Federal, tanto en Puerto Rico como en los Estados Unidos.
  2. En el caso de que cualquier reclamación contra Centro Ararat y/o sus empleados y la del hospital o institución médica en la que se reciba atención médica, estoy obligado a presentar cualquier reclamación bajo la jurisdicción de los tribunales del Estado Libre Asociado de Puerto Rico y renuncio a cualquier derecho a presentar una reclamación judicial en el Sistema de Tribunales Federales de los Estados Unidos.
  3. Usted acepta estos términos y condiciones y, de  la misma manera, que ha recibido y leído la información anterior y  comprende las razones de la recopilación de su información personal y de salud, así como las formas en que la información pudiera ser utilizada y divulgada, las cuales acepta y consiente.
  4. También confirma que entiende que utilizará su mejor criterio para decidir qué información proporciona, y que la retención o falsificación de información pudiera actuar en contra del mejor interés de su evaluación y progreso de su tratamiento médico.
  5. Usted está consciente de que puede acceder a su información personal y de salud a petición suya y, de ser necesario, corregirá o modificará la información que considere incorrecta, de acuerdo con la Política vigente.
  6. Usted entiende que si, en circunstancias excepcionales, se deniega el acceso al sistema de Telesalud con fines legítimos, que las razones de esta decisión y otros posibles recursos se pondrán a su disposición.
  7. Los Principios de Privacidad del Estado Libre  Asociado de Puerto Rico imponen varias restricciones a la Clínica Ararat  en relación con cualquier divulgación de información personal a receptores  extranjeros en ciertas jurisdicciones. Sin embargo, si la Clínica Ararat ha obtenido el consentimiento de la persona a tales transferencias, entonces dichas restricciones no serán aplicables.

Terms and Conditions - Telehealth Consultations

  

The purpose of this document is to outline the terms and conditions applying to “TeleHealth” consultations provided by Centro Ararat Inc. and/or one of its all related corporations. These entities, including their employees and other entities acting on their behalf are collectively referred to below as “Ararat Clinic”, “we”, “our” or “us”.


YOUR PERSONAL AND HEALTH INFORMATION

  1. Our Privacy Policy (Policy) is available on our websites at https://www.CentroArarat.org and https://ProtegeLoQueAmas.com (collectively referred to below as “our website”).  It describes how we collect, use and disclose your personal and health information and how you may request access to, and correction of, your personal information and how you may complain about a breach of your privacy and how we will deal with such a complaint.
  2. The Policy provides that by using our website and/or any digital portal(s) accessible via our website (collectively referred to below as “digital portals”), receiving products or other services from us, including, for example, participating in a TeleHealth consultation with a Ararat Clinic medial or health professional (such as a internist or clinician), you consent to Ararat Clinic collecting and using your personal and health information in accordance with the Policy. This form seeks to remove any doubts you may have about these matters.
  3. Ararat Clinic collects personal and health information about you for the purposes described in the Policy, including for the purpose of providing a quality service to you, including, if applicable, in the course of providing a consultation. In order to thoroughly assess, diagnose and provide therapy to you, we need to collect some personal information about you, including from you and third-party sources of information, as described in the Policy. If you do not provide this information; we may be unable to advise, assist and/or treat you.  This information will also be used for:
    1. The administrative purpose of running the practice;
    2. Billing either directly or through an insurer or compensation agency;
    3. Use within the practice if discussing or passing your case to another practitioner within the practice for your ongoing management;
    4. Disclosure of information to your doctors and other medical or health professionals to facilitate communication and best possible care for you.
  4. To help ensure that we can provide a high level of service to you, you agree that we may collect, use and disclose your personal and health information, including information about your assessment results and progress to relevant other service providers, who are involved in your management. These may include your doctor, teachers, specialists, insurers, solicitors or employers.


TELEHEALTH CONSULTATIONS

  1. You may make an appointment for a TeleHealth consultation by registering using a digital portal on our website and providing the information requested to create an account. The booking process for these consultations is managed through one or more third party add-on applications, platforms and/or other software programs. 
  2. Your Account information (including any and all login credentials and passwords) is confidential and it is your responsibility to maintain its security and confidentiality. You must not permit your account to be used by any person other than yourself. You agree that you will be responsible for any unauthorized activity that occurs as a result of any use of your account as a result of your failure to keep your account information confidential and secure. You  must notify Ararat Clinic immediately if you become aware of or suspect any unauthorized use of your account or your account information or any other breach of security of your account. In that event, Ararat Clinic, in its absolute discretion, may suspend or terminate your account and/or establish a new account for you. 
  3. You agree to provide accurate, current and complete information to Ararat Clinic in relation to booking an appointment, completing any questionnaires provided to you and in response to other questions or requests for information from Ararat Clinic in connection or during a consultation. You agree that any other information which you otherwise provide to Ararat Clinic will also be accurate, current and complete. You acknowledge that Ararat Clinic’s  ability to provide accurate information, treatment and recommendations to you depends on Ararat Clinic receiving accurate, current and complete personal and health information from you at all times. 
  4. Ararat Clinic reserves the right to not accept or to cancel any booking which you make for a TeleHealth consultation, and/or refuse to register, maintain or terminate your account, for any reason whatsoever, in Ararat Clinic’s absolute discretion. Without limitation, Ararat Clinic may cancel, terminate or refuse to register or maintain your Account or provide a consultation to you in its absolute discretion, if Ararat Clinic is of the opinion that you have not provided accurate, current or complete information in booking or otherwise in connection with or during a TeleHealth consultation. You acknowledge that Ararat Clinic has no obligation to provide any explanation or reasons to you for any decision Ararat Clinic makes to not accept, cancel or to otherwise refuse to maintain your Account or to provide a TeleHealth consultation to you. 
  5. Unless otherwise notified by Ararat Clinic:
    1. if Ararat Clinic provides a TeleHealth consultation to you, the consultation will be provided to you by the Ararat  Clinic medical or health professionals who Ararat Clinic makes available at the relevant time; and
    2. each consultation will not exceed ten (15) minutes in duration; and will be at no out of pocket expense to you, but billed to your health insurance; and
  6. You acknowledge that each TeleHealth consultation is general in nature and will only be provided over the telephone, via videoconferencing or over the internet. No consultations will be provided in person. Unless Ararat Clinic otherwise determines and you agree, no TeleHealth consultation will involve or oblige Ararat Clinic to approve, request or cause any form pathology testing or other testing or analysis to be undertaken.
  7. You acknowledge that if our medical or health professional determines that your case warrants referral to another medical or health professional, and you consent to the referral, you authorize Ararat Clinic to disclose any personal or health information Ararat Clinic has collected about you in accordance with the Policy to the relevant medical or health professional or his or her employer or principal organization. 
  8. To the maximum extent permitted at law, you indemnify and agree to keep Ararat Clinic (including all directors, officers, employees, contractors and agents of any entity within the meaning of that term) (Indemnified) fully indemnified from and against all loss, damage, cost and expense (whether direct, indirect, special or consequential) which any of the Indemnified suffer or incur as a result of, in connection with, relating to or arising from a consultation which you attend. You hereby release and forever discharge the Indemnified from any claims which you have or may have at any time as a result of, in connection with, relating to or arising from a consultation which you attend.
  9. You must not use our website or digital portals for any purpose for which you have not been authorized to use our website or digital portals for, including without limitation, for the purpose of hacking, infiltrating, compromising, interfering with, intercepting  or accessing any account or personal or health information of any other individual on or via the website or any associated software or applications. You must not introduce any computer viruses, macro viruses, trojan horses, worms or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer to the website or any associated software or application. You must not authorize, aid, abet or assist any other individual or entity to engage in any activities or do any of the things referred to in this clause 9.
  10. You acknowledge and agree that Ararat Clinic may, from time to time, update, vary or amend these terms and conditions. If we do so, we will publish the updated, varied or amended terms and conditions on our website and you agree to be bound by them with effect on and from the date on which they are published on the  website.  You agree to periodically check the website to determine whether there have been any changes to these terms and conditions from the last time you reviewed them.
  11. Nothing in these terms and conditions limits or intends to limit any non-excludable rights which you may have under the Puerto Rican Consumer Law. If any provision of these terms and conditions is void, voidable, unenforceable or illegal, that provision will be read down so as to be valid and enforceable or, alternatively, will be severed from these terms and conditions. The severance of any provision in accordance with this clause will not affect the validity or effectiveness of the remaining provisions of these terms and conditions.
  12. No failure to exercise or any delay in exercising any right, power or remedy by a party operates as a waiver. A single or partial exercise of any right, power or remedy does not preclude any other or further exercise of that or any other right, power or remedy. A waiver is not valid or binding on the party granting that waiver unless made in writing.
  13. The terms and conditions of this agreement are subject to the laws of the Commonwealth of Puerto Rico. In case of any legal claim against Centro Ararat and/or its employees I understand that the claim must be brought in the courts of the Commonwealth of Puerto Rico. I waive my right to process the lawsuit in the United States Federal Courts. 
  14. In the event that any claim against Centro Ararat and/or its employees and that of the hospital or medical institution in which medical attention is received, I am required to submit any claim under the jurisdiction of the courts of the Commonwealth of Puerto Rico and I forgo any right of making a judicial claim in the United States Federal Court System.
  15. You agree to these terms and  conditions and that you have received and read the Policy and the above information and understand the reasons for the collection of your personal and health information and the ways in which the information may be used and disclosed and you confirm that you agree to that use and disclosure.
  16. You also confirm that you understand that it is your choice as to what information you provide, and that withholding or falsifying information might act against the best interests of your assessment and therapy progress.
  17. You confirm that you are aware that you can access your personal and health information on request and if  necessary, correct information that you believe to be inaccurate in accordance with the Policy.
  18. You understand that if, in  exceptional circumstances, access is denied for legitimate purposes, that the reasons for this and possible remedies will be made available to you.
  19. The Commonwealth of Puerto Rico  Privacy Principles impose various restrictions on Ararat Clinic in relation to any disclosure of personal information to overseas recipients in certain jurisdictions. However, if Ararat Clinic has obtained the consent of the individual to such transfers, then those restrictions will generally not apply.
